Redundancies

The company I work for is going though yet another round of redundancies and sadly I have a 1 in 3 chance of staying put , So am in need of some help .. It's a long story but in short I transferred from South Africa to UK with the same company and as I was new here I didn't get the transfer in writing .Now the company has been sold twice since then and are now refusing to accept I was transferred as the pay out is rather a huge 1 to well about half now I think... I have contacted the company in South Africa who has also changed names now and they advised me that all papers from that time have been destroyed now.. The only thing I have in my possession is a photo copy of a letter thanking me for 10 years of service before I left SA ..... Would I be able to win a claim or would I need more than that,also if not would I be able to get help and do it at all .. Or is it just a accept it situation..

Have no idea what I will do if I am made redundant as it is all I have done since I left the air force aged 18.. Unfortunately my website is no where near good enough to keep me going and the slow (no) seo work don't really help either

I believe although I'm willing to be corrected that regardless of however many companies have taken over the original company your employment status will be from your original starting date. Unless that is you were made redundant on each takeover and then re-employed by the new company. If you were transfered here from another country, then that is continious employment. Not knowing what the SA employment laws are so have no idea whether they have redundancy packages or not. But as you are now in the UK, I'm guessing UK employment law / rights will supersede SA this link and this one may help.

It would probably be advisable to contact a solicitor that specialises in employment law and pay them for 1hr to get all the correct information, that way you won't get fobbed off by your current employer.........

thank you , it's a starting point for now ,but starting to look at other avenues in case I do get laid off

Do you not have payslips, tax docs, bank statements, etc that all show your wages for all this time? Annd how long have you been employed in total? And how long in the UK? And when you tx to the UK, was is a SA company based in the UK or a UK company?

unfortunately I don't have any wage slips etc ,with all the moving we've done they got lost along the way .. I went though all this last time there were redundancies but as I kept I job I sort of stopped

Try and dig out anything you can, old emails or maybe you can get access to old bank statements online? Good luck. It sounds like a load of cobblers and they're trying to rip you off. What happened to the old company? Are they not obliged to keep records for a limited amount of time and could you use a freedom of information request? I don't know how that would work in SA? Definitely try and get some free legal advice, most employment lawyers would offer free advice. Or even the CAB.

With your website, do you sell on Etsy or anything like that? I only ask as a client of mine set up her shop on Etsy and it made a lot more than her website, even with the commission/fees.

Fingers crossed you won't be made redundant.


thanks Rebecca .. You mention emails (made me giggle) they weren't invented back then were they. I think PC's were still in there infant stages back then and only the rich could afford them.

After a certain period of time all documents used to get destroyed as space was an issue back then... Anyway I found out today you can only get a max of 20 years and I'm at 17 so it's no big train smash ... I have also found out the that the sister company that deals with the bigger stuff is looking for someone in our area so I may just jump ship if it comes to it and not get redundancy pay

I'd echo Barney, and for this sort of thing go and talk to a solicitor and get some professional advice. It sounds like that any solicitor costs could be chicken feed to what you could be possibly losing

I'm officially out of work and am actually HAPPY about it ,sounds stupid but I am ,going up to Birmingham on Tuesday to fight it if I am able to .There was another job going on the industrial side( no redundancy package) but it was a heck of a lot more work for less money.But would rather get my redundancy package first to get myself out of debt completely... I have been offered a agency for the UK with a South African product ,just waiting for the details

Oh no! Or as it turn out oh yes? I hope it all works out well for you, keep us posted. Redundancies can often sort you out and lead you onto a path you'd rather be on, if you're positive and careful.

Good luck, do you mean fight for your redundancy package?
