Are business owners liable? 25th November 2013 10:18 PM

Following on from my previous post regarding insurance for delivery drivers, one of the comments that was past back to me by my employers is that they are not liable if we do not give our insurance details the correct details.

Before giving up my job to become a full time dad (not sure what is harder), we always had corporate responsibility drummed into us. If we (as managers) did not make the correct checks or give the correct training, then in the event of an incident, the company could be found guilty of corporate neglect.

For Example;
If a member of staff that drives all the time is involved in a serious accident due to using the phone whilst driving, who would be responsible in the event of a claim by a third party? My thoughts are either

The driver if...
... they have had the correct training - made aware of the law (although we all know it) - been told of any disciplinary that may occur should they not follow procedure - all of the previous mentioned is recorded on their training record card.

OR

The Employer if...
...no training has been given or recorded - no disciplinary action has been taken on repeat offenders.

Is this not a example of corporate responsibility?

Now back to my point.

When a new member of staff starts at our place, the following checks are made because in my eyes, it is the companies responsibility to do so.

Passports are photo copied, checked (name, gender etc) to ensure I am a legal worker and put on file.
Driving Licencees are checked to make sure drivers are legal to drive.
MOT's are checked to ensure the car is road worthy.
Insurance is checked to make sure the car we are using is insured. However, the occupation details are ignored because only three out of ten drivers have declared what they do.

Do companies not have the corporate responsibility to ensure that these details are correct? After all, if my passport photo showed a lady, name Mrs Mandy Smith - occupation, stripper, I'm sure they would have something to say.

Opinions or answers on this matter would be appreciated.

Whilst I have had my first order through for a website, it hasn't been enough to retire on. Therefore, I have still had to continue with my regular job of delivering Pizza's. That was until my insurance was due for renewal.

I was told that my insurance company did not need to know that I delivered pizzas as an occupation so it stayed as 'full time dad'. However, during the cause of the year, there were a few things that cropped up that got me thinking - um, I'm sure (i know) that's not right. So when my policy expired, I decided to ask my insurance company that I was thinking of taking a job as a deliver driver, how would it affect (effect?) my insurance? I got the simple reply of 'sorry, we wouldn't insure you'.

Because of the amount of time it took to sort out (four weeks), I will just briefly describe the issues and it was finally resolved. I realise that this could go on for a while but please bear with me. It's important and it got resolved really easily

The issue:
My insurance company DOES need to know about my occupation (No surprise there)
My wife needed business use as a named driver
During my hours of work I was covered by the works insurance but as a third party policy only. This caused problems with insurance companies because they classed it as dual insurance.
I get paid per delivery. Insurance companies got the impression I was driving around like Lewis Hamilton to earn more money.


What the experts said.
CAB said - I should be given a copy of the company insurance policy so that I am aware of the t&c's of the policy.
I should ask for a refund for the 'contribution ' I had been making as the policy was effectively void should I be involved in an accident.

Okay, so after two years of studying, several part time jobs ans a few weeks in between, I have managed to get my first order from a total stranger.

I haven't been on here for a while because i've been busy trying to get my first order. I set a target of getting an order before the end of this month and I've done it. Boy does it feel good.

Okay, I know it's not much but it's a start.

Leaflet dropping and talking to business owners done it for me. What's more, I walked past this guy thinking he was going to tell me the normal excuse 'why do I need a website?' but I thought 'that's not going to get you anywhere' so I went back. I gave him a leaflet, he phoned that night and ordered it two days later.

See, perseverance does pay.

I am now starting to advertise my business but I'm not too sure what avenue to take when it comes to advertising.

I have had a local magazine around and they quoted me
I was always told to buy both domains if possible. However, if my business was just aimed at the British market, then I would be better off with just the .co.uk name.

I have recently discovered (somebody else may have another opinion) that Google likes your site better if you have a .co.uk domain and you are only targeting customer within the uk.

Seeing that the other site is Russian and they are not selling the same items as you, I wouldn't worry about it.
