This fascinated me so much, i actually sat down with a coffee & read the doc from the link in the original thread - well its just blown Barneys & my argument out the water - 

"I supplied and fitted a dishwasher for a customer under an off-premises contract. A week
later she contacted me and told me she no longer wanted the dishwasher, that it had not
been used and that she was returning it. Can she do that?
10. Yes she can provided she cancelled within 14 days of delivery of the dishwasher at her
home. Although plumbed in, the dishwasher can be removed. She must however pay you
the charge agreed for the installation service you provided. This is provided you had her
express consent to start the work in the cancellation period and told her she would have to
pay. She must also pay for the return of the dishwasher, if you told her she would be liable,
in advance and provided you did not deliver the dishwasher to her at the time the contract
was entered into. In addition, she will be liable for any diminished value if when the
dishwasher is returned it shows signs of use."

I suppose the only thing that covers anything is the diminished value for signs of use and the fact that she must pay the labour costs, assuming that was expressly consented to the instillation going ahead - guess this would apply to boilers too?

I'm flabbergasted by all of this, (albeit only to DSR contracts) whilst i accept some professions are crying out for this cover, others must be up in arms !!!

Will watch this develop with interest over the coming months, i have a feeling the Courts are going to get busier !

I know CJD is just interpreting the Law and not making it, but i have to agree with Barney.

Here's a scenario - my boiler packs up in the middle of winter and i call a plumber out - need to have a new boiler fitted but because he is worried about the new Directive, he says he cant fit it for 2 weeks, i'm left in a freezing house pretty peeved!

2 things will happen, IMHO, 1) the plumber gets a bad name through no fault of his own, 2) the flood gates open on unqualified, unregistered plumbers taking up the slack. To be honest how many people would look the other way on a registration with Gas Safe if it means that they get instant heating!

Common sense will have to prevail in these kind of instances and maybe the Directive will not apply to fitted items in the future. Maybe i'm wrong .....

took me over 2 hrs this morning to do around 6 miles

 

Took me 15-20 minutes to do 7 miles -  - kind of off track of the thread now though 

Wonder if we will see another dragon buy him out?

Now seems a scarily prophetic post in light of what happened to the school teacher Anne Maguire... People say we are normally about 10 years behind America, lets hope in this case it is isolated.

Can you imagine kids having to walk through metal detectors and having onsite school security Or maybe this already happens in some areas?”

 

Sure i read sometime ago some inner City schools already have them - such a tragedy. Cant imagine what would drive a 15 year old to stab a teacher.

The £50 note with the picture of Sir John Houblon on is being withdrawn on Wednesday, but some Post Offices and Banks will still accept them until October.

Being divorced and father of 2 teenagers, can't recall the last time i saw a £20 note let alone a £50 .....

We encountered the pressure selling of the FSB when we were a new start up business.

We were offered membership when we had only been trading for 6 months even though they advertise that a stipulation of membership is that you have been trading for a minimum of 2 years.

We declined membership purely based on the fact that were willing to 'relax' the rules for us to join.

I don't want to be a part of an organisation that will take anyone, I want to be checked, vetted and recommended on our true merits.

Yes it may have increased our workload, but if I am displaying a membership of a supposedly creditable association, then I expect all members to fulfill the requirements that the public expect.

It takes years to earn a good reputation and seconds to lose it.”

I did invite them in to talk to me/us many years ago but at the time i could not see any advantage to the fees or being a member - admit they were pushy but put that down to a passionate salesman rather than over zealousness. They did follow up several times but then i'd expect that of any salesman chasing up a lead.
