Lego loses its red brick trademark

Found this really hard to get my head round. That good old kiddies favourite, Lego has been told by the European Court that its 1996 Trademark of an 8 studded red brick, is now invalid.

Rival manafacturer "Megabrands" challenged the trademark, and this was backed up by European Court of Justice "that protecting the shape and function of a product would reduce the opportunities for rival manufacturers to use them"

Thought that was the idea of a trademark!

It does seem a bit odd that you can have a trademark in place for 14 years and then it gets overturned.

Not when you think that Santander has more money to throw around, Lego loses it and then Santander hammer out their advertising with it!

Shock, Horror!

Eurotrash!

Whats next? Apple will lose theirs as its unfair on spanish apple growers who need to advertise something the same size and shape?
