Insurance is void?

What are the cases if Insurance is void?
I actually want to know that are hazards covered in case of human negligence, Like my friend owns a clothing (Cotton) Industry. His employee was smoking near the chemicals, no one actually noticed as they were busy. This small negligence of the manager, the factory was burnt to ashes.
Now the Insurance company is not covering the damages as they think it was not accidental.
What to do now?
Any suggestion ???

Insurance can be voided for a variety of reasons, most common is non disclosure of facts.

In this case it would seem your friends insurers are investigating suspected arson and not an accidental fire. Smoking in a factory with chemicals & flammable materials wasn't the brightest of things to have done and i guess that's what the insurers are looking in to.

Without being in possession of all the facts its impossible to make any judgement analysis but i would go as far as to say your friend has a problem!

Sometimes, people burn their old property to get new and this fault was made by your friend's employee so you have to prove that it was an accident. It was not done intentionally.

Yep good point but the insurers will also be looking in to the possibility that the said employee was paid off to start the fire & claim smoking caused it.

Lets be honest, if you are smoking next to flammable materials & chemicals, doesnt take much common sense to realise these dont mix

Sounds like a very unfortunate situation. I would suggest hiring an attorney. Hope that your friend gets everything worked out!

File a case. Get the recordings from cctvs (if possible). Hire some real good insurance lawyer.
  1. Ask for an explanation.
  2. Match it with your disclosures.
  3. Take help of your insurance agent.
  4. Do not accept filing errors as ground for refusal.

According to your post, The owner of the factory did not take the necessary steps to stop fire from consuming his factory. Allowing people to smoke inside the factory was negligence of the highest order given that he knew the factory had chemicals. This is not an accident may be we can call it a stage managed accident and your friend is not entitled to any compensation.
