And what should I claim for? So the boiler manufacturer admits full liability for the damage it caused me last year. Technically the physical damage / injury's would probably be classed as being on par with a serious whiplash accident.... I had about 3 months out of work in total, my main client who I had worked for for several years where the incident happened pulled the plug, They alone were worth between £100k - £200k per year..... which has all gone... Then there were individual clients who all went elsewhere.... And although I still have all my gas safety documents to work with, I no longer do so through total lack of confidence or be anywhere near it... I'm not even sure whether I will renew my registration with Gas Safe next year.... So it has certainly been a costly experience.... But where is the line drawn in regards to damages? This went far more beyond what a rear end shunt in a car does.....

Shouldn't you work out a daily rate of what you normally would earn + any other expenses incurred. You shouldn't be out of pocket in my book ,also you have lost your main income , unless you are doing something else already
I wouldn't say I lost my main income, as all the other customers combined are worth more, but individually the estate agent was a customer worth keeping.... Thanks, Barney
Blimey, if the manufacturer has accepted full liability, then you must be entitled to loss of earnings, business, stress etc etc. Sounds like you need to sit down with a decent solicitor and sooner rather than later. This will be a nice retirement fund
The first solicitor I had didn't want to take on the manufactures, so pulled out after a month. I then got in touch with solicitors who do a lot of work for union related stuff, although I've never been in a union they took the case, although I had to do all the detective work and prove that it had happened previously, thankfully an exact same incident had been logged with the HSE.... was never after compensation, just an apology and an explanation would have been enough but they tried to put the blame on me, which didn't help at all... so now I'm going all out to get fair treatment..... besides I've now lost my good looks permanently Thanks, Barney
Barney I agree that you should go all out to get fair compensation. Look at it this way, if you had caused the problem then somebody would be very quick to seek the same from you. If you have the manufacturer's admission of liability in writing then that's a good start. You can then build your claim with medical reports, written evidence of business/income lost and damage to reputation/stress/confidence (all impact on your earning ability), also sleepless nights/shouting at the cats. Can your PL company provide details of any legal support similar to when you claim for injury through your car insurance? Haven't used one myself, but some of the "no win no fee" companies who advertise on TV may handle this type of claim. When I claimed for whiplash it certainly opened my eyes to just what you can list as affecting your normal life as a result. The doctor (not my own) examined me then asked a lot of work-related questions, was I still able to do normal tasks like washing-up, dressing, housework; he even asked if my sex life had been affected! The solicitor was provided by the insurance company. The guilty party's insurer tried to blame for stopping at the junction..... Good luck Barney. Yes, you may have to do a lot of the work yourself but there's nothing wrong with seeking rightful compensation not only for injury, but lost earnings, stress, etc. Realise your problem is more serious so apologies, I may have stated the obvious above. Well, I have another meeting with the solicitors on the 7th of December... I say another meeting, I haven't met them yet as everything is done over the phone or email. At the moment neither the solicitors nor the manufacturers have any idea of just how much financially out of pocket I am... So we'll have to see how it goes.... Thanks, Barney |
